Public Notice: Resolution of Intent to Permanently close unopened right of way of Windham Drive

TOWN OF LA GRANGE, NORTH CAROLINA

RESOLUTION OF INTENT TO PERMANENTLY CLOSE UNOPENED RIGHT-OF-WAY OF WINDHAM DRIVE

Pursuant to N.C.G.S. §160A-299

Resolution No. 2025-___

WHEREAS, the Town of La Grange has received requests from adjoining property owners to permanently

close an unopened portion of a right-of-way identified as Windham Drive, which has never been

constructed or opened for public use; and

WHEREAS, the unopened section of Windham Drive extends beyond the existing improved street

through undeveloped property and serves no current or future public transportation purpose; and

WHEREAS, adjoining property owners, including Ms. Debbie Jones of 308 Robina Drive, have expressed

concerns about individuals traveling through the area and potential increases in traffic associated with

the current phase of the Blair Ridge Subdivision; and

WHEREAS, the Town Council of the Town of La Grange finds that the unopened right-of-way is not

needed for public use and that its closure would promote orderly land development, clarify property

boundaries, and eliminate unnecessary right-of-way from the Town’s inventory; and

WHEREAS, N.C.G.S. §160A-299 authorizes municipalities to permanently close any street or portion

thereof that is not needed for public purposes, following proper notice and a public hearing; and

WHEREAS, adoption of this Resolution of Intent is the first step in the statutory process and establishes

the date, time, and place of a public hearing to consider the proposed closure.

NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of La Grange, North Carolina,

that:

1. Intent to Close: The Town Council hereby declares its intent to permanently close the unopened

portion of the right-of-way known as Windham Drive, more particularly described as follows:

Segment 1 (Windham Drive – Segment ID 236263 – 56658): Beginning at South Carey Street and

extending generally eastward to Robina Drive within the Town of La Grange municipal limits,

having an approximate length of 416.30 feet. The segment lies within the corporate limits of the

Town of La Grange, and is municipally owned. Detailed Legal Description in attached Addendum.

Segment 2 (Windham Drive – Segment ID 236307 – 56639): Beginning at Robina Drive and

extending generally eastward to a dead-end terminus within the Town of La Grange municipal

limits, having an approximate length of 538.76 feet. The segment lies within the corporate limits

of the Town of La Grange and is municipally owned. Detailed Legal Description in attached

Addendum.

2. Public Hearing: A public hearing on the proposed permanent closure of the unopened right-of-

way of Windham Drive shall be held at 6:00 p.m. on Monday, November 3, 2025, at the La

Grange Town Hall Council Chambers, 203 South Center Street, La Grange, North Carolina.

3. Notice of Hearing: The Town Clerk is directed to:

a. Publish this Resolution of Intent once each week for four consecutive weeks in a newspaper of

general circulation prior to the public hearing;

b. Post a copy of this Resolution at two or more prominent locations along the unopened portion

of Windham Drive proposed for closure for a minimum of twenty (20) days prior to the hearing;

and

c. Mail a copy of this Resolution by certified mail to all property owners adjoining the portion of

the right-of-way proposed to be closed.

4. Purpose: The purpose of this Resolution and the subsequent public hearing is to allow all

interested persons an opportunity to be heard on the question of whether closing the unopened

right-of-way of Windham Drive would be contrary to the public interest or would deprive any

individual owning property in the vicinity of reasonable access to their property.

5. Further Action: Following the public hearing, the Town Council may adopt an Order to

Permanently Close the Unopened Right-of-Way of Windham Drive if it determines that the

closing is not contrary to the public interest and that no property owner will be deprived of

reasonable access as a result of the closure.
